Oregon's Health CO-OP (OHC) Liquidation Order

A motion to liquidate OHC was filed with the Marion County Circuit Court on March 1, 2017, resulting in the Order Authorizing Liquidation and Approving Receiver’s Liquidation Plan being signed by Circuit Court Judge David Leith on March 2, 2017.  The company was previously ordered into rehabilitation on July 11, 2016. Based on the information known to the Receiver, OHC is insolvent within the meaning of ORS 734.170.  ORS 734.170(5) states that an insurer is insolvent when the insurer is unable to pay its obligations when they are due, or when its allowed assets do not exceed its liabilities.

The Receiver mailed proof of claim forms to all potential claimants in April 2017 for submission by midnight September 30, 2017. POCs mailed after the 9/30/17 filing deadline will fall to the lowest position in the Preference of Claims (order of payment) according to ORS 734.360, and it is anticipated that the assets of OHC will not be sufficient to make a distribution to any claims in that category.
